Hotel Accommodation Service Sales Agreement

1- PARTIES:

On one side, the natural and/or legal person who accepts this agreement and purchases the accommodation service online, hereinafter referred to as the Customer, and on the other side, Guesthouse By West Hotel, located at Reşadiye Mah. Küme 5. Evleri No:9/1 Datça-Muğla, hereinafter referred to as the Hotel, collectively referred to as the Parties.

These parties acknowledge that this agreement constitutes a formal offer, contains all the terms and conditions for providing paid accommodation services, and all terms stated below and available on www.guesthousebywest.com are binding and non-negotiable by the Customer. The parties have executed this agreement under the terms outlined below.

2- SUBJECT OF THE AGREEMENT:

This agreement governs the manner in which the accommodation service sold by Guesthouse By West Hotel to the Customer will be provided, and defines the rights and obligations of the parties.

2.1. Under this agreement, the Hotel is obliged to provide accommodation services upon the Customer’s request (hereinafter referred to as the “Service”).

2.2. By signing/approving this agreement (the Customer agrees by making a reservation for accommodation and/or services offered by the Hotel), the Customer confirms that they have been informed about the accommodation rules, reservation policies, and tariffs.

2.3. The parties shall be deemed to have entered into the agreement once the Customer completes all steps of the online reservation process or when the Hotel confirms the Customer’s request in writing for non-online reservations.

3- SERVICE DESCRIPTION:

Detailed information about the accommodation service is available on the Guesthouse By West Hotel’s service information page at www.guesthousebywest.com.

4- RESERVATION PROCEDURE:

4.1. Service reservations can be made by calling +90 533 710 48 00, sending an email to reservation@guesthousebywest.com, completing all steps of the online reservation on www.guesthousebywest.com, or applying to the Hotel in person.

4.2. If the Customer wishes to cancel or modify their reservation, they must comply with the terms of this agreement and apply to the Hotel by phone, email, or in person as described. The Hotel will respond in writing.

4.3. Requests for changes must be submitted no later than 7 (seven) days before the accommodation start date by the Customer or their authorized representative using one of the methods outlined in 4.2.

4.4. The Customer may request up to two changes or cancellations free of charge. Additional requests will incur fees according to the Hotel’s change, reservation, and cancellation tariffs.

4.5. The Customer accepts that any changes to special discount period reservations (such as early booking) will be subject to the price lists valid at the time of the new reservation. Special discounts will not apply outside the discount period.

4.6. The Hotel will respond to change requests based on availability.

5- TRANSFER:

5.1. Name changes or transfers of reservations under the same terms are subject to the Hotel’s rules and must be notified in writing at least 7 days before the reservation start date.

5.2. Changes in reservation information will result in cancellation of the reservation and termination of this agreement.

6- PRICE AND PAYMENT METHOD:

The total price, including all taxes, is detailed in the reservation form/agreement.

Payments shall be made according to the Hotel’s policy either by credit card at the time of reservation, via EFT/bank transfer to the Hotel’s specified account, or upon check-in.

6.3. Full payment is required at the time of online reservation.

The Hotel will clearly indicate payment terms (prepaid or payable on-site) during the transaction.

6.4. The Customer is responsible for entering accurate credit card information during online payment.

6.5. The Hotel’s payment system is protected by security measures, but the Hotel is not liable for damages resulting from third-party access due to Customer negligence or harmful software.

6.6. The Customer must present the credit card used for payment or a photocopy during check-in; failure to do so will make the Customer responsible for any resulting damages.

6.7. Invoices will be issued at checkout or sent to the Customer’s provided address if not collected.

6.8. Payments via the official website will be in Turkish Lira; bank transfers can be made in EUR, USD, or GBP based on Central Bank rates.

6.9. The Hotel is not responsible for payments made outside its official channels.

7- REFUNDS AND CANCELLATIONS:

7.1. Full refunds are available if cancellation is made at least 30 days before check-in via approved methods; refunds will be processed within 15 business days minus fees.

7.2. Except for documented serious illness or death of the Customer or first-degree relatives, cancellations made less than 30 days before check-in are non-refundable.

7.3. Cancellations 29-15 days before check-in: 50% refund.

7.4. Cancellations 14-7 days before check-in: 20% refund.

7.5. Cancellations less than 7 days before check-in: no refund.

7.6. Refunds for credit card payments will be made back to the original card/account.

7.7. Refunds will be net of commission, taxes, and other expenses.

7.8. No refunds will be made if the Customer withdraws after check-in unless the Hotel fails to fulfill its obligations.

8- ACCOMMODATION TERMS:

8.1. Age and identity of the Customer and companions will be verified upon check-in. The Customer accepts legal responsibility for any false information.

8.2. Extra expenses during the stay will be paid at checkout.

8.3. Check-in time is from 14:00 on the day of arrival; check-out time is by 12:00 noon.

8.4. Pets are not allowed.

9- NOTIFICATION PERIOD:

The Customer must report any service defects or failure to perform within 7 days to the service provider and the Hotel in writing.

10- LIABILITY OF THE PARTIES:

10.1. The Hotel is responsible for failure or improper fulfillment of obligations.

10.2. The Hotel shall provide alternative or additional services in case of non-force majeure failures. Acceptance waives claims for compensation beyond the alternative services.

10.3. Compensation claims will follow applicable laws and regulations.

10.4. The Customer agrees to compensate the Hotel for any damage caused by breach of contract.

10.5. The Hotel reserves the right to modify terms based on seasonality.

11- FORCE MAJEURE:

The Hotel is not liable for cancellations or delays due to force majeure events (weather, strikes, war, natural disasters, etc.).

12- MISCELLANEOUS:

12.1. The Hotel reserves the right to change special event programs for reasons beyond its control.

12.2. The Hotel reserves the right to seek compensation for damages caused by the Customer.

12.3. Customers must not send goods/materials on behalf of the Hotel; the Hotel is not responsible for customs.

12.4. Smoking is prohibited in closed areas by law; designated smoking rooms do not imply allowance throughout the Hotel.

13- EFFECTIVENESS:

13.1. The Customer confirms having read, understood, and accepted the terms electronically or by confirmed reservation.

13.2. The agreement is effective upon Customer approval and ends when service is consumed or cancelled.

14- TERMINATION:

14.1. The Customer is entitled to compensation if the Hotel terminates without just cause.

14.2. No compensation if termination is due to insufficient bookings or force majeure.

15- JURISDICTION:

Muğla Courts and Enforcement Offices shall have jurisdiction over disputes. The Customer accepts this jurisdiction.
